The American Choice Awards voting and research is based on feedback from consumers and do not reflect the opinions of The American Choice Awards. The winners of each category are determined by consumer voting based on a proprietary methodology developed by The American Choice Awards and may include Purchase Consideration, Product and Brand Appeal  Familiarity, Quality, other category-based criteria and perceived appeal from people who had previously purchased or used the product or brand. Winners receive the highest numerical scores within each category’s specific attributes and criteria which are not necessarily statistically significant and may not necessarily reflect the actual market. The consumers’ experiences with the winning product and brands may vary. The American Choice Awards does not represent nor warrant that any individual consumer experience will be consistent with the results of the voting, surveys and any accompanying research. The American Choice Awards reports the results from the consumer voting and surveys, and does not warrant nor represent the quality or satisfaction with, or efficacy or safety of, any individual product. Any and all responsibility for quality, performance or safety of any product rests with the individual manufacturer or participant. The American Choice Awards shall use commercially reasonable efforts to ensure the security and accuracy of all votes and the voting process, however, such methodologies are not infallible, and The American Choice Awards makes no guarantee as to their effectiveness. The American Choice Awards is not liable for any perceived or actual defect in the quality, performance, efficacy or safety of any product, or any injury or death resulting, or alleged to have resulted. The participant agrees that they will not disparage or make negative or derogatory comments about the winners, nominees, voting, methodology, process, awards, The American Choice Awards or its employees or officers. The American Choice Awards may change vendors, processes, timelines, celebrities, talent, media distribution, methodologies, competition, structure, systems, awards titles, or any other aspect as it deems necessary.

 

Advertising and Promotion

 

The American Choice Awards maintains the right to promote nominees and winners in advertising and publicity efforts in conjunction with the American Choice Awards, Best Brand Award, and official logos throughout the term of the contest and awards publicity. The activities may include but are not limited to photographs, illustrations, film, video, digital reproduction and depiction of the winning brands and products, labels, packaging and trademarks. Media distribution may include but is not limited to television, print and digital publications, social media, blogs, websites, retail promotions, mobile apps and other methods deemed appropriate by The American Choice Awards. Likewise, upon confirmation and receipt of the official artwork, participants may promote and publicize their nominations, wins, trophies, official logos and “American Choice Awards’ Best Brand” tagline (and variations) in any and all communications. Winners must use the official winning category name approved by The American Choice Awards.

The American Choice Awards, its affiliates, voting, polling, research, promotion and advertising partners, vendors and other relevant entities are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, the Site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of voting information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to vote, including any injury or damage to participant’s or any other person’s computer or mobile device relating to or resulting from participating in the voting or downloading any materials. The American Choice Awards is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, technically flawed or misdirected votes, which will be disqualified.
